"Boutique & Beautique"

1.Introduction

  • Welcome to "Boutique & Beautique!” the platform connecting users with local boutiques, tailors, bridal dress/makeup artists, and customized dress designers. These Terms of Use ("Terms") govern your access and use of the App. By accessing or using the App, you agree to be bound by these Terms. If you disagree with any of these Terms, you are not authorized to use the App.

    • 2. Definitions
  • App: The "Boutique & Beautique" mobile application.
  • User: An individual who uses the App to browse and contact local businesses
  • Customer: A business owner who registers their establishment on the App.
  • Establishment: A boutique, tailor, bridal dress/makeup artist, or customized dress designer registered on the App
  • Content: Any information, data, text, graphics, photographs, images, audio, video, or other materials displayed on or submitted to the App

    • 3.User Accounts and Access

    3.1 Users:

  • Users can access the App by signing up with their phone number and verifying the OTP
  • Users are responsible for maintaining the confidentiality of their account information and password and for restricting access to their device.
  • Users agree to accept responsibility for all activities that occur under their account

    • 3.2 Customers:

  • Customers can register their establishments on the App by providing accurate and complete information, including store name, contact number, email, address, location details, and Google Maps link.
  • Customers are solely responsible for the Content they submit on the App, including its accuracy, completeness, legality, and reliability. You warrant that you have the necessary rights and authority to submit the Content and that it does not infringe on any third-party rights.
  • Boutique & Beautique reserves the right to remove or disable any Content that it deems, in its sole discretion, to be offensive, illegal, or otherwise inappropriate.

    • 4. Location Access and Sharing

  • We access the location of both users and customers to provide accurate search results and improve the app experience
  • Users can set their location sharing preferences within the App. We may share users' location with third-party maps apps to provide seamless navigation
  • We may share users' and customers' location data with third-party analytics providers for internal audit and service improvement purposes.
  • We store location data for internal audit purposes and to maintain accurate map functionalities
  • Location data will be anonymized before sharing with third-party providers

    • 5. Order Registration and Disclaimers

  • While the App allows users to register orders with establishments, we are not an ecommerce platform and do not facilitate payments or transactions
  • We are not responsible for the accuracy or completeness of the information provided by establishments. Users are advised to directly contact establishments for confirmation and verification before placing any orders.
  • We are not responsible for the quality, warranty, or other aspects of products or services offered by establishments. Users are solely responsible for any transactions they make with establishments.
  • We disclaim any liability for any damages or losses arising from interactions between users and establishments.

    • 6. User and Customer Conduct and Prohibitions

  • You agree to use the App only for lawful purposes and in accordance with these Terms.
  • You may not use the App to:
  • Violate any laws or regulations;
  • Infringe on the rights of others, including intellectual property rights;
  • Submit false or misleading information;
  • Impersonate any person or entity;
  • Interfere with the operation of the App;
  • Engage in any behavior that is harmful, offensive, or threatening.
  • We reserve the right to terminate your account or access to the App for any reason, at our sole discretion

    • 7. Intellectual Property
  • The App and its Content are protected by intellectual property laws, including copyrights, trademarks, and trade secrets. You may not use any Content without our express written permission.
  • The trademarks, logos, and service marks ("Marks") displayed on the App are the property of Boutique & Beautique or its licensors. You may not use any Marks without our express written permission.

    • 8. Disclaimer and Information Accuracy Policy

    Disclaimer of Responsibility:

    Boutique & Beautique acts solely as a platform connecting users with local businesses. We are not responsible for the accuracy, completeness, or legality of the information provided by businesses registered on the App, including, but not limited to:

  • Product details, descriptions, or images
  • Product quality or warranties
  • Prices or availability
  • Business contact information
  • Any other claims or representations made by businesses

    • Users are solely responsible for verifying the information provided by businesses before engaging with them. We encourage users to contact businesses directly for confirmation and clarification.

    Information Accuracy Policy:

    Businesses registered on B&B are responsible for ensuring the accuracy, completeness, and legality of the information they provide. This includes, but is not limited to:

  • Providing factual and current information about their business and products.
  • Complying with all applicable laws and regulations
  • Avoiding false or misleading claims

    • We reserve the right to remove or disable any content that we deem, in our sole discretion, to be inaccurate, incomplete, or illegal. Additionally, we may terminate the account of any business found to be repeatedly providing false information or engaging in illegal activities.

    No Notice Account Deletion:

    If we discover that a business has provided false information or is engaged in illegal activities, we may deactivate or delete their account without prior notice. This is to protect users from harm and ensure the App remains a reliable platform for connecting with legitimate businesses.

    9. Limitation of Liability
    TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF YOUR USE OF THE APP, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, AND PUNITIVE DAMAGES.
    This means:
  • You are responsible for any losses or damages you incur by using the App.
  • We are not liable for any losses or damages you cause to others while using the App.
  • We are not liable for any lost profits, business interruption, or other intangible losses you may experience due to the App.

    • 10. Termination
    Account Deletion by User:
  • Users can terminate their account at any time by deleting the App from their device.
    • Account Deletion by Customer:
  • Customers can submit a request for account deletion by sending an Email - contact@care4edu.com
  • We will process account deletion requests within 60 days of receipt.
  • During the 60-day processing period, your account may still be accessible while we fulfill any outstanding obligations or responsibilities related to your account.
  • After 60 days, your account and all associated data will be permanently deleted.
    • Important Note:
  • Deleting your account does not remove any Content you have submitted to the App, such as reviews or ratings. This Content may still be visible to others after your account is deleted.
